Kano State government has filed fresh five count charges to arraign the killer and his two accomplice before a Kano State High Court.
The State’s Director Public Prosecution, Bar. Aisha Mahmoud disclosed this to newsmen after the case came up for mentioning at the Magistrate court.
Barrister Aisha explained that the govt filed the charge at the High Court because the Magistrate court lacks the jurisdiction to trial the offences filed against the defendants.
According to her, the magistrate court sitting at gidan Murtala lacks jurisdiction to trial the case,due to the gravity of offences committed by the accused persons.
The Kano state director public prosecution,pointed out that they have appealed to the court to remand the accused persons pending the hearing of the case at the high court.
” we informed the court that we have filed a five count charges before the High Court. The Chief Judge has directed the case to Court 5 and they are expected to fix a date for the persons to be arraign before the court”
The Magistrate court presided over by Chief Magistrate Mohammed Jibrin granted the prayers and ordered the accused persons to be remanded in custody.
Chief Magistrate Jubril however adjourned the case to February 9th, 2022.
The charges filed against Abdulmalik and his accomplice borders on criminal conspiracy, kidnapping, confinement and culpable homicide contrary to section 97, 274, 277, 221 of the penal code.
It could be recalled that, Abdulmalik Tanko and his accomplice are accused of brutally kidnapping and Killing his five year old student Hanifa.
